This website, https://straithhospital.org (the “Site”), is operated by Straith Hospital for Special Surgery, a Michigan nonprofit corporation (“Hospital,” “we” or “us”). The privacy and security of your information that you share with us is important to us, and we respect and take steps to protect it.
This Policy addresses the privacy and security of the information that visitors to the Site provide to us, the types of personal information and other data the Site collects from visitors, how we use and disclose this information, and the steps we take to protect the privacy and security of this information.

As used in this Policy, personal information does not include certain individually identifiable health, medical and related information about you, known as “protected health information,” the privacy and security of which is governed by the Health Insurance Portability and Accountability Act of 1996 and the regulations promulgated thereunder (“HIPAA”), the applicable state of Michigan laws protecting confidentiality of health information, and professional ethics. Please refer to our Notice of Privacy Practices for information about our privacy practices regarding protected health information under HIPAA. In the event of any conflict between the Hospital’s HIPAA Notice of Privacy Practices and this Policy, the terms of our HIPAA Notice of Privacy Practices shall control.
All visitors use the Site anonymously, and we do not collect your personal information through the Site unless you voluntarily provide it. We may collect and store your name and e-mail address and other personal information that you choose to voluntarily provide to us, such as in responses to questionnaires on the Site, in connection with the services you may be requesting from us, through our forms such as request appointment forms and e-newsletter sign-ups. If you do not want us to obtain personal information about you while or as a result of using the Site, please do not provide it to us.
We may track, use and disclose to third parties non-personal information about your visit to the Site, including the domain name and the name of the Web page from which you entered our Site, how much time you spend on each of our pages, and the IP address associated with your computer or other device used to access our Site. To be removed from future marketing e-mail or SMS text message campaigns, you can also call us 855-STRAITH or e-mail your request to info@straith.org, and identify the name and e-mail address to which your opt-out request relates. Please note that if you are a patient of the Hospital, these opt-out requests do not include communications related to services provided to you at the Hospital and these communications are managed separately through our patient portal.
Your information submitted or collected through the Site is stored on the server that delivers the Site. The server is accessible by us and by those who help manage the server hardware and software.
We take security of your personal information seriously, and use commercially reasonable efforts to protect it against loss, theft and misuse, as well as unauthorized access, disclosure, alteration and destruction. However, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information that you provide or transmit to us online, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any firewalls or secure server software we may employ. We continue to evaluate and implement enhancements in security technology and practices, however we can only take steps to help reduce the risks of unauthorized access.
We have put in place procedures to deal with any suspected or actual theft, loss, unauthorized access or other personal information breach that may affect you, and will notify you and of a personal data breach where we are legally required to do so. By using this Site or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of this Site and any personal data breaches. The Site may use other similar technologies to gather information about you, such as IP addresses and location data, to customize your visit, to enable us to evaluate usage of and enhance the Site, our services, or for other purposes.

The Site is designed for those 18 years of age and older. We do not knowingly solicit or collect information from anyone under the age of 18. We do not intend to collect any personal information or data from Canadian and European Union users. If you are from the European Union or Canada, do not provide us with your personal information through the Site. If we learn that we collected personal information or data through the Site from a user from the European Union or Canada, we will promptly delete that information.
This Policy will be governed by, and interpreted, construed and enforced in accordance with, the internal laws of the State of Michigan, USA without giving effect to any choice or conflict of law provision or rule (whether of the State of Michigan or any other jurisdiction) that would cause the application of the laws of any other jurisdiction.
The State of Michigan, USA shall be the exclusive jurisdiction for all claims, disputes or proceedings arising out of or related to this Agreement, provided however that nothing in this Section shall prevent us from seeking or obtaining equitable relief or other rights or remedies from any other court or tribunal of competent jurisdiction.
This Policy supersedes and replaces all previously posted Privacy Policies.
We reserve the right to update this Policy at any time in our sole and absolute discretion, and your continued usage of the Site will constitute acceptance of the updated Policy. If we decide to change our Policy, we will post those changes to this Site and it will become effective upon posting. If the change would cause us to use or disclose personal information in a manner that is materially less restrictive from that stated at the time of collection, we will notify our Users before implementing the change.
